This website, www.pfafirm.com (the “Site”), is maintained by Personal Fiduciary Advisors, LLC. Throughout these terms and conditions (the “Terms of Use”), “PFA”, “we”, “us” or “our” refers to Personal Fiduciary Advisors, LLC and “you” or “your” refers to the visitor to the Site. 

By accessing the Site, you acknowledge and agree to accept these Terms of Use, the Site’s Privacy Policy and any notices, conditions or guidelines located within the Site. If you do not agree with any of these items, please do not use the Site and exit it now. 

  1. Privacy Policy, Updates, Age of Majority, Questions or Comments 

The terms and conditions of the Site’s Privacy Policy apply to your use of the Site, form an integral part of your agreement with us, and are incorporated by reference into these Terms of Use. Your use of the Site does not provide you any ownership interest or rights in that Site Content or intellectual property. 

We hereby grant you a limited, revocable, non-exclusive and non-transferable right to view, store, download, copy and print Site Content solely for your personal, educational and non-commercial use. You may not use any trademark, service mark or logo of PFA or any third party that appears on the Site without the prior written consent of its owner. Unless you receive our prior written permission, you may not use any Site Content commercially, distribute it, post it on another web site, or otherwise copy, distribute or modify it. If you download any Site Content, you agree that you will not remove or obscure any copyright or other notices or legends on it and you will not alter or modify any copies you make of it. 

We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion and without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site or the entire Site.

If you link other websites to the Site, you may not suggest or imply that PFA has endorsed or is affiliated with such websites; 
  • Use the Site to transmit any virus, worm, time bomb or similar system interference of a destructive nature to or through the Site. You also may not otherwise disrupt, modify or interfere with the functioning of the Site or any software, hardware or servers associated with the Site, interfere with others’ use of the Site or alter any Site Content; 
  • Use any robot, spider or other automatic device, process or means to access the Site for any purpose, including monitoring or copying any of the material on the Site; 
  • Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer or database connected to the Site; 
  • Attack the Site via a denial-of-service attack or a distributed denial-of-service attack; 
  • Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site; or, 
  • Engage in any conduct that, as determined by us, may expose us or users of the Site to liability. 

A breach or violation of any of the Terms of Use entitles us to immediately terminate your access to the Site. We have the right but not the obligation to monitor the Site for any unauthorized or objectionable conduct and to take all appropriate actions in response without notifying you.

The Site is for general informational purposes only and it is not intended to be nor is it a substitute for professional tax, legal, accounting, insurance or investment advice, and nothing provided on the Site constitutes tax, legal, accounting, insurance or investment advice. Any links or references to other websites, products or services are provided solely as a convenience to you and, unless expressly stated otherwise, do not constitute an endorsement by us. Any decisions you make based on information provided on the Site are your sole responsibility. Your use of the Site does not create a client or other type of engagement with PFA.

PFA operations are located in the United States, the Site is operated and controlled by us in the United States, and the Site is intended solely for users located in the United States. We make no claims that the Site or Site Content is applicable or appropriate for viewing outside the United States. Access to the Site from countries or territories where such access is illegal is prohibited. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 

PFA and its officers, owners, employees, affiliates and agents (collectively “Related Persons”) make no representations or warranties of any kind and specifically disclaim any and all warranties of any kind, express or implied, with respect to the Site and Site Content, including any representations or warranties with respect to merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, freedom from viruses or malware, completeness, timeliness, functionality, reliability or delivery. We use reasonable efforts to obtain information from reliable sources, but Site Content is provided “as is” and PFA does not warrant that Site Content is accurate, reliable or complete. 

Information cannot be transmitted on the internet in a manner that is 100% secure and third parties may unlawfully intercept or access transmissions that are intended to be private. Accordingly, email and other transmissions to or from this Site or made via this Site may not be secure and you use this Site at your own risk.

By accessing the Site, you agree to indemnify PFA and its Related Persons and to hold PFA and its Related Persons harmless from any and all claims and expenses, including attorneys’ fees, arising from your use of the Site or your violation of any of these Terms of Use.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information you provide us through the Site are not confidential and you grant us a worldwide, royalty-free license to use your submissions without limitation and without any acknowledgement of or compensation to you. 

  1. Governing Law 

The laws of the State of South Carolina shall govern these Terms of Use. Any dispute relating to these Terms of Use or your use of the Site shall be resolved solely in the state or federal courts located in Berkley County, South Carolina. You agree to waive trial by jury in any such action. 

  1. Severability and Enforceability 

If any provision or portion of these Terms of Use is held illegal, invalid or unenforceable, in whole or in part, it shall be modified to the minimum extent necessary to correct any deficiencies or be replaced with a provision that is as close to it as legally permissible, and such modification or replacement shall not affect the legality, validity or enforceability of any other provisions or portions of the Terms of Use.

We reserve the right, in our sole discretion, to revoke, terminate or suspend your right to access the Site for any or no reason, including your improper use of the Site or your failure to comply with these Terms of Use. We may assign, replace or subcontract any or all of our rights and obligations under these Terms of Use at any time.
